01The agreement

These terms are between you and Elizabeth Dane Home (“we”, “us”). [Legal entity name and form to be confirmed by the owner.] By using elizabethdanehome.com (the “site”) you agree to them. If you do not, please do not use the site. Our privacy policy explains what we collect and is part of these terms.

02What this site is

The site is a home-decor journal with a catalog. We photograph real rooms, mark the pieces in them, and link each piece to where it can be bought. Today every purchase is completed on Amazon.

We do not sell products directly, take payment, hold inventory, or ship anything. The bag on this site is a list, not an order. You check out on Amazon today; that will change, and when it does these terms will be updated first.

03Purchases through Amazon

When you follow a product link or send your bag to Amazon, you leave our site. From that point Amazon’s Conditions of Use, Privacy Notice and return policies govern everything: price, availability, taxes, shipping, delivery, returns, refunds and customer service.

• Prices and availability on Amazon change without notice. We do not display Amazon prices here, and nothing on this site is an offer to sell at any price.
• We cannot see, change or cancel an Amazon order. For help with an order, contact Amazon.
• Product listings on Amazon are written by Amazon and its sellers. We choose the products; we do not control the listings, and a listing may change or disappear after we link to it.

We may participate in the Amazon Services LLC Associates Program. As an Amazon Associate we may earn from qualifying purchases made through links on this site. It costs you nothing extra, and it does not influence which pieces appear in a look.

04Your bag

The bag is a convenience stored in your browser. Adding a piece to it does not reserve stock, lock a price or create any obligation for you or for us. When you check out, we build an Amazon cart link from the items in the bag; Amazon may show different quantities or availability than you expected, and the order you place there is between you and Amazon.

05The letter

If you give us your email address we will send you the letter: a short note when a new look is up, and the occasional seasonal list. You can stop it at any time with the link at the bottom of any email or by writing to hello@elizabethdanehome.com. We will not sell or rent your address. Details are in the privacy policy.

06Our content

The photographs, words, the wreath seal, the name Elizabeth Dane Home and the design of this site belong to us or to people who have let us use them. They are protected by copyright and trademark law.

• You are welcome to view the site, share links to it, and pin or repost a photo with credit.
• Please do not copy our photographs or text onto another site or product, remove credits, or use our name or seal to suggest we endorse something we do not.
• Automated scraping, bulk downloading and any use of our content to train machine-learning models are not permitted without written permission.

Amazon, Instagram, Facebook and Pinterest are trademarks of their respective owners. We are not affiliated with them beyond the programs described here.

07Acceptable use

Use the site as a person would. Do not try to break it, overload it, submit forms automatically, probe for vulnerabilities, sign other people up for the letter, or interfere with anyone else’s use of it. We may block traffic that does, without notice.

08Links and third parties

The site links to Amazon, Instagram, Facebook and Pinterest, and may link elsewhere. Those sites are not ours. We are not responsible for their content, availability, policies or practices, and a link is not an endorsement of everything found there.

09Disclaimers

The site is provided “as is” and “as available”. Styling notes are our opinions from living with these pieces; they are not professional advice, and your room, light and taste will differ. Measurements, colours and materials should be checked on the Amazon listing before you buy.

To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted or error-free, or that any product will be available or suitable.

10Limitation of liability

To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from your use of the site or from any purchase you make on Amazon. Our total liability to you for anything arising from the site will not exceed one hundred US dollars (US$100). Some jurisdictions do not allow these limits; where that applies, they apply only as far as permitted.

11Governing law and disputes

These terms are governed by the laws of the State of Texas and applicable United States federal law, without regard to conflict-of-law rules. If we have a disagreement, write to us first at hello@elizabethdanehome.com and we will try to sort it out. Any dispute that cannot be resolved that way will be brought in the state or federal courts located in Texas, and you consent to their jurisdiction, except that either of us may bring a qualifying claim in small-claims court.

12Changes to these terms

We may update these terms as the site grows, for example when checkout moves on-site. The effective date at the top will change when we do. Continuing to use the site after a change means you accept the new terms.
